Defensive gun use incidents

This is a partial list of defensive gun uses. Compiling a list such as this can be a difficult and controversial process, as there is no strict definition of defensive gun use. For more information on the criteria used to determine the contents of this list, please see the criteria for inclusion section below.

12/16/2012 USA San Antonio, TX An off-duty sergeant took down a gunman who attempted to open fire at a crowded movie theater lobby during a late night showing of “The Hobbit” in San Antonio. The off-duty police sergeant, identified as Lisa Castellano, fired four times, wounding the gunman, identified as 19-year-old Jesus Manuel Garcia. Prior to being stopped by Castellano, the gunman was able to shoot one man in the chest, but both the man shot and the criminal are expected to survive. [1][2]
11/30/2012 USA Detroit, MI An 81 year old man from Detroit was woke to the sounds of a brick shattering his glass door. He reached for his .22 Pistol and fired at the intruder three times. The intruder fled the scene. The 81 year old was unharmed. [3]
11/21/2012 USA Milwaukee, WI Clemon Ferguson and Jeremy Pierce knocked on the locked door of Milwaukee hair salon "Hair Fantasies", and were let in by a customer. One of the men drew a gun and pointed it at the customer in the salon. The customer knocked the suspects arm away, and a shot was fired. The customer then drew his own gun, shooting both men. Ferguson died at the scene, and Pierce was wounded. Pierce later went to the police claiming he was shot when someone tried to mug him, but later admitted that story was false. Pierce is charged with Felony murder due to the death of Ferguson, the customer will not be charged in the shooting. [4]


10/25/2012 USA Orlando, FL Three armed men broke into a home near UCF, the homeowner confronted the men pulling out his own weapon and shooting one of the invaders several times. The two other men escaped through a second story window. [5][6][7]
10/17/2012 USA Bryan County, OK The 12 year old Kendra StClair was at home alone, when an unknown man (later identified as 32 year old Stacey Jones) rang the doorbell. The girl did not answer, and the Jones went to the back door of the home and kicked in the door. The girl called her mother, Debra StClair, who told her to get the family gun, hide in a closet, and call 911. The girl was on the phone with 911 as Jones went through the house, and when he began to open the closet, the girl shot him through the closet door. Jones ran away from the house and was found by the police and taken to the hospital. He was later charged with 1st Degree Burglary. Jones had previously been arrested for kidnapping an 18 year old mentally disabled girl. [8][9][10][11]
9/9/2012 USA Plymouth, PA William J. Allabaugh was inside Bonnie's Food and Spirits, a local pub, reportedly making racial statements. Other patrons had also complained about Allenbaugh being armed in the bar. Allabaugh was told to leave, and while being escorted out, drew a handgun and shot a black patron, Stephen Holman in the head while he was chatting on his cell phone. Holman is in critical condition. Allabaugh then shot passerby Scott Luzetsky outside the bar multiple times, killing him. As Allabaugh walked down the street, he approached the bar owner Bob Wallace, and patron Mark Ktytor who had gone outside and were hiding behind a car. Allabaugh pointed his gun at the two men, at which point Ktytor drew his own weapon and shot Allabaugh multiple times. Ktytor then called 911. Allabaugh is in the hospital. Authorities said that Allabaugh has been charged with Homicide and Attempted Homicide. Ktytor will not be charged. [12][13][14][15]
9/3/2012 USA Verona, KY Three men broke into the home of 92 year old WWII veteran Earl Jones. Jones shot one of the men in the chest with his .22 caliber rifle, killing him. The other two men fled taking the body with them. They later called 911 and were arrested. Jones was not charged in the shooting. [16][17][18]
9/3/2012 USA New Orleans, LA In the aftermath of Hurricane Issac, a looter was breaking into a home without power at 1:45am. The owner shot the intruder who was taken to the hospital, and charged with attempted burglary and looting. [19]
9/2/2012 United Kingdom Leicestershire, England Four men broke into the rural home of Andie and Tracy Ferrie early on Sunday morning. The Ferries have been the victims of multiple burglarazations. Andie Ferrie shot at the men with his legally owned shotgun, causing them to flee. He then called for the police. Meanwhile one of the wounded robbers also called for an ambulance. The four men were arrested on suspicion of burglary. The police did not reveal if they were armed, or were suspects in any other crimes. The Ferries were arrested on suspicion of Grevious Bodily Harm. Several British politicians have spoken out in support of the couple saying they should not be charged for defending their home. They were later released, and prosecutors said they would not be charged. [20][21][22][23][24][25]
8/28/2012 USA San Antonio, TX Teresa Barron was dropping her daughter off at school when the childs father, Roberto Barron, arrived and began an argument. Roberto began to stab Teresa in the neck with a knife multiple times. A bystander with a concealed carry permit ordered Roberto to stop. When he continued to stab Teresa, the bystandared threatened to shoot, and held Roberto until police arrived. Teresa was taken to the hospital in critical condition. Roberto was arrested for aggrivated assault. The bystander was not charged for his brandishing of the gun. [26][27]
8/25/2012 Germany Cologne, Germany A tiger escaped its cage at the Cologne Zoo, and killed a zookeeper. The Zoo was evacuated and police were called, but the Zoo director shot and killed the tiger with a rifle before they arrived. [28][29]
8/19/2012 USA Bradenton, FL A man was walking with his dog, when a pit bull attacked his dog. The man shot the pit bull with his .38. Police have said they will not file charges. [30]
8/19/2012 USA Las Vegas, NV A man wielding a large ("full size"/"more than 3 feet") "samurai-type sword" sword attempted to rob a local Dairy Queen. He was shot twice by one of the employees, and died at the scene. [31]
8/16/2012 USA Hendersonville, NC An 87 year old woman scared off two robbers in her home at 3 AM, by brandishing her 9mm pistol. The two men, Christopher Aaron Lewis and Lance Millard Staton, were later arrested, were armed, and were suspects in a string of related robberies. [32]
8/14/2012 USA Dora, AL Michael Jacobs broke into the home of Martha Lewis while Lewis and her daughters were sleeping. Lewis called the police, and warned Jacobs that she was armed. Jacobs continued to advance towards Lewis and she shot him. Jacobs was taken to a local hospital, and was charged with Burglary, Mischief, and drug charges. Police have said Lewis will not be charged. [33]
7/23/2012 USA Malboro County, SC Two men broke into the home of an 89 year old grandmother Ruby Hodge. When they saw her pistol, they ran away and were later arrested. [34][35]
7/17/2012 USA Ocala, FL Two teens attempted to rob a local internet cafe, and were shot by a 71 year old man. The teens were subsequently arrested. [36]
7/12/2012, 7/14/12 USA Twin Falls, ID A man posted an ad on craigslist, pretending to be his wife. The ad said that the wife had a rape fantasy, and solicited men to break into her home and enact the fantasy by raping the woman. On two separate occasions men forcibly entered the home and attempted to rape the woman. On the first incident, the woman fired her gun and the assailant ran away. In the second incident she held the man at gunpoint until police arrived. [37][38]
6/30/2012 USA Chesterfield, VA During a power outage, two robbers (one armed) entered a convenience store. The owner, William Avaloa, pulled his own gun and aimed at the armed robber. The unarmed robber ran away, and the armed robber placed his weapon on the store counter and fled. One of Avaloa's sons grabbed a shotgun in the store, and the other grabbed the robber's weapon. [39]
6/27/2012 USA Tacoma, WA A 62 year old man returned home and found appliances and wiring missing. The next day he heard voices one of whom yelled "Tacoma Police!". When he went downstairs, two robbers were in the home, one wielding a hatchet, which was thrown at the home owner. He shot the man with a shotgun and the assailants ran away. The shot man was later arrested. [40]
6/22/2012 USA Phoenix, AZ A 14 year old boy was babysitting his siblings when an armed intruder broke into the home and pointed a gun at the family. The family retreated upstairs where the boy retrieved his father's gun, and then shot and critically injured the intruder. [41][42]
6/19/2012 USA Tacoma, WA A burglar was crawling through the window of a home and was shot with a shotgun by the homeowner. [43]
6/9/2012 USA Rogue River, OR Richard Batson broke into the home of Becky Goode, and claimed someone was trying to kill him. Goode asked the man to leave saying, "Dude, you need to get out of my house"; and herself eventually fled the home, leaving her daughter sleeping upstairs. When police arrived Batson had left, and police eventually tracked him to a neighbor's house where Roy Pirnie was holding the man at gunpoint. Batson was arrested but later released due to overcrowding in the jail. [44]
6/8/2012 USA Galveston, TX Elvis Alexander, broke into the home of Carrie King, where he had sometimes mowed the lawn. King shot the man several times with a paintball gun allowing the police to easily identify him later. [45][46]
5/30/2012 USA Huntsville, AL Cordell Pride attempted to rob the "Atlantis" convenience store while armed, and was shot by the clerk. Pride died later at the hospital. Police stated of the clerk "We don't encourage them to be armed but he has his right to be armed". Pride had a record of several robberies and was suspect in other crimes. At the time of the incident, there had been robberies at local businesses on 13 out of the 14 previous days. [47]
5/3/2012 USA Chicago, IL Musa Thomas attempted to rob a jewelry store using a handgun, where he was known and had previously sold gold. When the register only contained $11, he forced the owner, 66 year old Georgi Layous to open the safe, and tore a necklace off of Layous's 4 year old grand-daughter. When the thief was distracted while trying to erase security tapes of the robbery, Layous asked his wife to hand him his handgun (in Arabic), and he shot Thomas in the leg. When police arrived they arrested Thomas, and confiscated Layous's gun, as handguns were illegal in Chicago at the time. Layous was not charged with any crime. [48]
5/1/2012 USA Modesto, CA Two men broke into a home while the residents were sleeping. One of the residents confronted the robbers with a coat-hanger; that man's step father, a 62 year old former Marine, shot at the robbers with his .357 Magnum revolver. As the robbers retreated he fired again striking one of the men in the leg. The injured man flagged down a police car, and was taken to a hospital. The other man was not captured. [49]
4/26/2012 USA Salt Lake City, UT A man stabbing shoppers in a local grocery store was stopped when a shopper drew his gun and told him to drop the knife. [50]
4/22/2012 USA Aurora, CO A man attempted to shoot a church member, then shot a pastor's mother outside of a local church, and was subsequently shot and killed by an off-duty police officer who was carrying a gun. [51][52]
4/19/2012 USA San Antonio, TX 89 year old Fannie Mae Brown was woken up when burglars entered her home and were approaching her bedroom. She shot at them with her .38 revolver and scared them away. [53]
3/30/2012 USA North Bend, WA A 46-year-old man and his girlfriend awoke to the sound of glass breaking when an intruder threw a propane tank through their back sliding-glass door. Despite several warnings, the intruder broke into a bedroom where the couple had fled and was shot. [54]
2/27/2012 USA Colorado Springs, CO An armed man entered a doctors' office and took several hostages. One of the doctors used his gun to guard the stairs to allow people to escape while he covered their retreat. The attacker was later shot by the police. [55]
2/09/2012 USA Houston, TX Two men broke into a home and confronted a mother and her ten year old son. She shot at them with her older son's .22 rifle and they ran away. [56]
12/31/2011 USA Blanchard, Oklahoma 18 year old Sarah McKinley was in her home with her 3 month old baby, shortly after her husband had died of cancer. Justin Martin, who was addicted to pain killers, broke into her home, while wielding a knife, looking for prescription drugs which may have been left over from McKinley's husband's treatment. McKinley was on the phone with 911 for 21 minutes during the breakin. When Martin managed to enter the home, McKinley shot him with a 12 gauge shotgun, after asking 911 for permission. Martin's accomplice Dustin Stewart had stayed outside the home, but was charged with Felony murder [57]

8/22/2010 Canada Port Colborne, Ontario Men attacked the home of Ian Thompson, hurting one of his dogs, and throwing firebombs at his home. Thompson fired three shots from his .38 handgun scaring away the assailants. Four men who were neighbors were later arrested in relation to the incident. Thompson was initially charged with the counts of unsafe storage of a firearm, as well as unsafe use of a firearm and pointing a firearm. The unsafe usage charge was later dropped. The trial for the unsafe storage count is ongoing. [61][62][63]
2/2009 USA Miami, FL Carlos Rodriguez was leaving a Miami club when he was confronted and beaten by a group of men. He shot one of the assailants, Tariq Smith, who survived. He was arrested for the shooting but was ultimately one of the first acquittals under Florida's Stand Your Ground law. [64]
5/35/1998 USA Winnemucca, NV 30-year-old Ernesto Villa Gomez walked into the bar and starting shooting. 20-year-old Jose Torres and his 19-year-old brother Margarito Torres were killed. When Villa Gomez was reloading his semi-automatic gun, a man from Reno took out a gun and shot Villa Gomez. That man has a concealed weapons permit. [65][66]
12/9/2007 USA Colorado Springs, CO Matthew J. Murray, armed with a semi-automatic rifle and two pistols, entered the foyer of the New Life Church and fatally shot two, and wounded three others, before himself being shot and wounded by Jeanne Assam, a former sworn Colorado police officer and a church member acting as security. 1/13/2007 Israel Meitar Shai Dromi is an Israeli farmer who, in an act of self-defense, shot and killed a trespasser and wounded another at 3am after discovering his dog had been poisoned, allegedly by four intruders. On 15 July 2009, he was acquitted of manslaughter but convicted on charges of illegal possession of weapons. The rifle he had used belonged to his father and not registered in Dromi's name. A public uproar drew much attention to Dromi's plight and a law was proposed by Member of Knesset Yisrael Katz and later passed by a large majority in the Knesset. The law, commonly known as the 'Dromi Law', considers opposition to intruders as self-defence. Shai Dromi [68][69]
3/2/2007 Canada Montreal, Quebec Police entered the home of Basil Parasiris using Dynamic entry, while executing a search warrant. Police rushed into the home before dawn while the Parasiris family was sleeping. Parasiris was not aware that the people in his home were police, and thought he was victim of a home invasion. He grabbed his .357 Magnum revolver and shot officer Daniel Tessier in the head and the heart, killing him. Officer Stéphane Forbes was also wounded. Parasiris was charged with murder and attempted murder, as well as illegal weapons charges but was acquitted of all counts, on grounds of self-defence. The warrant that was used to enter his home was judged to be an illegal warrant. the jury in the murder case was not informed of the illegal nature of the warrant during their deliberations. 2/17/2006 USA Baton Rouge, LA Officer Brian Harrision was escorting a funeral procession when he pulled George Temple over and wrote him a ticket for breaking into the procession. In response, Temple attacked Officer Harrison. Perry Stevens was passing by and heard Officer Harrison's yells for help. He ordered Temple to get off of the officer, and when Temple continued to attack, Stevens shot him 4 times in the abdomen with his .45 caliber handgun. Temple continued to fight, and Stevens shot him once more, in the head. Officer Harrison had also fired one shot into Temple at some time during the struggle. Police ruled the shooting justified. 9/12/2005 USA Kennesaw, Georgia Kimberly Boyd was driving her SUV, when convicted rapist and child molester Brian O'Neil Clark forced his way into the vehicle and took control of the car. During the strugle for control of the vehicle, Clark shot Boyd, but then as a result of the struggle, the SUV crashed into a passing cement truck, killing Boyd. Shawn Roberts, a passing motorist saw the struggle, and began to follow the SUV before it crashed. After the crash, O'Neil attempted to flee the scene. He pointed his gun at Roberts, who fired his own weapon hitting O'Neil three times, killing him. The gun that O'Neil was carrying had been stolen from a woman a few days earlier during a crime in which the woman was raped, forced to drive to an ATM and withdraw cash, but the victim escaped by running into the bank. O'Neil matched the description of the earlier perpetrator. Roberts was quoted as saying "It's not [politically correct] to run around in public wielding a handgun, but it's sometimes necessary," he said. "And [it's] our moral responsibility — not just [that of] the police — [to] defend other lives when we can". a Cobb County grand jury cleared Roberts of any charges. A bridge near the scene of the incident was renamed the "Kimberly Boyd Memorial Bridge". Boyd's husband lobbied the legislature unsuccessfuly to implement "ATM Panic Codes" to help others in similar situations, but did persuade the legislature to increase penalties for sex offenders, and implement lifetime electronic monitoring for some sexual predators. 10/14/2004 Ireland County Mayo Pádraig Nally, an Irish farmer living in County Mayo shot dead an Irish Traveller named John "Frog" Ward, with a string of 80 convictions over 30 years, who had been trespassing on his property. In November 2005 Nally was sentenced to 6 years imprisonment for manslaughter. His conviction was quashed in October 2006 and, in December 2006, he was found not guilty of manslaughter. 1/16/2002 USA Grundy, VA A 43-year-old Nigerian former student Peter Odighizuwa arrived on the Appalachian School of Law campus with a handgun. Odighizuwa proceeded to the offices of Dean Anthony Sutin and Professor Thomas Blackwell, where he opened fire with a .380 ACP semi-automatic handgun, killing three people. When Odighizuwa left the building where the shooting took place, he was approached by two students with personal firearms and one unarmed student. At the first sound of gunfire, Tracy Bridges and fellow student Mikael Gross, unbeknownst to each other, ran to their vehicles to retrieve their personally-owned firearms placed in their glove compartments. Mikael Gross, a police officer from Grifton, North Carolina retrieved a 9 mm pistol and body armor. Bridges, a county sheriff's deputy from Asheville, North Carolina. retrieved his .357 Magnum pistol from beneath the driver's seat of his Chevrolet Tahoe. Bridges and Gross approached Odighizuwa from different angles, with Bridges yelling at Odighizuwa to drop his gun. Odighizuwa then dropped his firearm and was subdued by several other unarmed students, including Ted Besen and Todd Ross. Appalachian School of Law Shooting[75]
4/24/1998 USA Edinboro, PA 14-year-old Andrew Jerome Wurst fatally shot 48-year-old John Gillette, and wounded another teacher and two students[76] at Nick's Place (a nearby restaurant) during an 8th grade graduation dance.[77] The shooting ended when the owner of Nick's Place, James Strand, intervened and confronted Wurst with his shotgun, ordering him to drop his weapon and later holding him at bay for eleven minutes. Strand later got Wurst on the ground and searched him for weapons, finding a dinner fork in his sock.[78] Parker Middle School dance shooting
11/1997 USA Austin, TX A fan of video game maker Richard Garriott broke into Gariott's home. Garriott verbally warned the intruder, who continued to advance up the stairs; Garriott fired a warning shot from his Uzi, and the intruder ran into one of Gariott's bedrooms to hide. When police arrived they found the intruder naked in the bed. [79][80]
10/1/1997 USA Pearl, MS 16-year-old Luke Woodham (born February 5, 1981), killed two students and injured seven others at his high school. Before the shooting at Pearl High School began, Woodham stabbed and bludgeoned his mother to death in his home. The school's assistant principal, Joel Myrick, retrieved a .45 pistol from his truck and, spotting him near the parking lot, shouted for Woodham to stop. Woodham instead got into a his mother's car and tried to escape. Myrick, a US Army Reserve commander, detained Woodham until authorities arrived.[81][82] Pearl High School shooting[83]
11/14/1993 USA Brooklyn, NY Arthur Boone was buying a pack of cigerretes at 3am, when two men approached him and attempted to mug him. One of the muggers held a pearl handled pistol to his head while the other attempted to take his wallet. Boone drew his .44 handgun and shot both men, one in the head, the other in the chest; both died. It was later found that the pearl handled gun was a pellet gun. Boone then waited for police to arrive. Boone was charged with having an unlicenced weapon, but was not charged in the killings as police determined he had acted in self-defense. [84]
4/29/1992 USA Los Angeles, CA During the 1992 Los Angeles riots which occurred after the acquittal of the police involved in the Rodney King trial, looting and violence spread through Los Angeles. During the riots, many Korean immigrants from throughout the area rushed to Koreatown, after Korean-language radio stations called for volunteers to guard against rioters. Many were armed with a variety of improvised weapons, as well as shotguns and semi-automatic rifles. LA Riots and the Korean American community[85][86]
1989 USA Maryland Sharon-Jo Ramboz was in her home when someone broke in. She retrieved her Colt AR-15, and inserted a magazine. She then chambered a round. The intruder fled when he heard her loading the weapon. This incident was subsequently used in the 1995 congressional hearings to repeal the Assault weapons ban. [87][88][89]
11/21/1976 USA Rankin, TX Police officer Sammy Long was killed by a motorist the officer had pulled over. Two college students saw the shooting and went for help. A nearby hunter used his deer rifle to shoot and kill the motorist. Upton County District Atty. Aubrey Edwards said the coeds and the hunter requested their names not be made public and said the hunter "deserved a medal" for his action. [90][91]
6/21/1966 England Wendens Ambo, Essex Reginald Calvert entered the home of Major Oliver Smedley regarding a business dispute with the pirate radio station the two were involved in. A violent struggle developed during which Smedley shot Calvert dead with a shotgun. During the subsequent trial, Smedley claimed that he feared Calvert was there to kill him and was acquitted on grounds of self-defence. Reginald Calvert
12/15/1946 USA Connellsville, Pennsylvania John Jaynes, a retired police officer, when attacked by his wife with a butcher knife, successfully defended himself by shooting her. He was charged by acquitted at trial based on his defense of self-defense. [92][93]
1928 USA New Mexico Mr. Greenlee came upon his spouse engaging in an adulterous act with a paramour, and fearing for his life, used a firearm to kill the paramour in self-defense. The New Mexico Supreme Court upheld his innocence. [94][95]
11/21/1920 USA Ardmore, OK Jake Hamon, an Oklahoma politician and oil magnate, was shot by Clara Smith Hamon, his longtime secretary and mistress. Jake Hamon had arranged a marriage between Clara and his nephew to allow Clara to take his name. Jake died some days after he was shot, with Clara claiming that he gave her $5,000 and told her to flee to Mexico. Clara ultimately returned to Oklahoma and was tried for murder, but was acquitted based on her testimony that she was being beaten by him at the time of the shooting. The story of the shooting was dramatized in the 1921 move "Fate", which starred Clara Hamon playing herself. [96][97][98][99]
2/4/1892 USA Baltimore, MD Joseph McCartney was pickpocketed by Samuel Stallings after drinking together in a local saloon. As McCartney left, Stallings attempted to extort money from McCartney for the return of his watch. McCartney refused and was attacked by Stallings. McCartney shot Stallings who died. McCartney was charged with murder but acquitted. [100]
1856 USA Huntsville, Missouri A recently purchased slave somehow got loose on the streets of town, and attempted to shoot a number of men with a pistol as he tried to flee. He was stopped when local armed citizens gunned him down. [101][102]
1853 USA Hempstead County, Arkansas Disabled slave overseer James Martin, after being threateningly approached by a slave named Nathan who refused to be whipped, defended himself by shooting Nathan three times, thus saving his life. Martin prevailed in a lawsuit to recover his wages from the slave's owner, who contested the necessity of the killing. [103][104]
1838 USA Alexandria, Louisiana Upon being approached by a runaway slave acting strangely and carrying a large butcher knife, overseer McCorkle defended himself by shooting the slave, and was held not liable for damages to the slave's owner. [105]
1758 France New France, North America In the vicinity of present-day Arkansas, trader Francisco Morvan shot and killed fellow trader Jean Dufour dit Brindamour in self-defense, after a very inebriated Brindamour claimed that he was owed skins by Morvant. [106][107]


Criteria for inclusion

Incidents for inclusion should follow the guideline criteria below.

  • Use of a firearm
  • By a civilian
    • Excluding police, military or paid armed security while acting in the line of duty
    • Including the above if they were off-duty and out of uniform and acting in a private capacity
  • Where the user was the victim of, or witness to a crime, including assault, robbery, rape, murder etc. or animal attack
  • Where the user brandished, fired, or otherwise used the gun to stop or mitigate the crime, by scaring, detaining, wounding, or killing the perpetrator
  • Where the user was not charged (or if charged, not convicted) of a crime under Castle doctrine, Stand-your-ground law, or other Self defense justification
    • For incidents occurring in a jurisdiction that does not have self-defense laws, incidents where the gun user is charged, may be included if reliable sources quote the self-defense nature of the incident, especially if commented on by relevant notable people such as local politicians or police.
  • Where reliable sources can verify the basic facts of the incident

Excluded should be incidents where

  • The use of the firearm was by police, military or paid armed security while acting in the line of duty
  • The user of the firearm was a criminal in the act of committing a crime
  • Duels, fights, or other incidents where the user was a voluntary participant in mutual violence
  • The user made a self-defense claim but was ultimately charged and convicted of a crime as a result of their use of the gun (i.e. Jesus C. Gonzalez)
