Al Razak v. Bush
(Civil Action No. 05-CV-1601)
(Civil Action No. 05-CV-1601)
is a writ of habeas corpus filed on behalf of several Guantanamo captives.[1]
The Military Commissions Act of 2006 mandated that Guantanamo captives were no longer entitled to access the US civil justice system, so all outstanding habeas corpus petitions were closed.[2]
On June 12, 2008 the United States Supreme Court ruled, in Boumediene v. Bush, that the Military Commissions Act could not remove the right for Guantanamo captives to access the US Federal Court system. And all previous Guantanamo captives' habeas petitions were eligible to be re-instated.
On July 18, 2008 Rebecca P. Dick filed a status report on a number of captives, including four whose cases were amalgamated in 05-CV-2367, who were still held in extrajudicial detention in Guantanamo.[1]:
976 Abdullah Wazir Zadran 1001 Hafizullah Shabaz Khail 1100 Abdullah Mujahid 1119 Hamidullah - On July 18, 2008 Shayana D. Kadidal of the Center for Constitutional Rights filed a "status report" on behalf of Hamid Allah Mowlowi Saedara Saed Abd Al Razak in Civil Action No. 05-cv-1691.[3][4][5] His attorneys were able to determine that Hamid Allah Mowlowi Saedara Saed Abd Al Razak was also known as Hamidullah, Qari Hamdullah, and that he had Civil Action No. 05-cv-1601 filed on his behalf.[3] The two petitions were merged on April 12, 2007.
Lead petitioners
On January 8, 2007, the Center for Constitutional Rights published a list of "lead petitioners".[6] Alan Sussman and Barbara Olshansky were listed as the lead petitioners on Civil Action No. 05-cv-1601. William Goodman was listed as the lead petitioner for Civil Action No. 05-cv-1691.
